Detailed explanation-1: -A mother is a legal heir to her deceased son’s property. Therefore, if a man leaves behind his mother, wife and children, all of them have an equal right on his property.
Detailed explanation-2: -So, when a Hindu male dies intestate, his property will go to Class I heirs. These include son/daughter widow; mother; son/daughter of the predeceased daughter; widow of the predeceased son; son/daughter of the predeceased son; widow of the predeceased son.
Detailed explanation-3: -If a Hindu male leaves behind neither class I, nor class II, nor any agnates, nor any cognates upon his death, then, his entire property lapses to the government. This is called as “Escheat”. When government takes his property as heir, it takes with subject to all the obligations and liabilities of propositus.
Detailed explanation-4: -Only in the absence of the last heir of the husband, the property will devolve upon her mother and father. Now let’s take an example of a well-earned childless widow who dies intestate, then as per Hindu Succession Act 1956, whatever she has earned will go to her husband’s heir i.e., her husband’s mother.
Detailed explanation-5: -In the absence of a class II heir category, the property shall devolve upon heirs in class III or agnates which primarily comprises the leftover heir who are blood relatives of the intestate related to him through a whole male chain of relatives.
