Detailed explanation-1: -The Commission held that under Section 24(1) read with Second Schedule of the RTI Act, 2005, CISF has been declared an exempt organization. Hence, the provisions of the RTI Act are not applicable to the CISF except when the information pertains to allegations of corruption or human rights violations.
Detailed explanation-2: -Right to information sought has certain exceptions such as public interest, friendly relations with state and also personal information which does not have anything to do with the work. Right to privacy and right to seek information are two sides of a coin.
Detailed explanation-3: -Most of the intelligence agencies are excluded from the ambit of RTI Act, 2005 as would be seen from Schedule 2 to the Act. However, Central Bureau of Investigation (CBI) and Directorate General of Central Excise Intelligence (DGCEI) are notable exclusion to this exemption.
Detailed explanation-4: -For example, any information which is exempted from disclosure under Section 8 of RTI Act, 2005 is liable to be disclosed if the application is made with regard to the occurrence or event which took place or occurred or happened twenty years prior to the date of the request vide Section 8(3) of the RTI Act.
