Detailed explanation-1: -In no circumstances can the accused be detained in custody for a moment more than twenty four hours without a special order of a Magistrate who can order his detention for a term exceeding 15 days on the whole. At the end of the 15 days he must be produced before the Magistrate.
Detailed explanation-2: -magisterial custody beyond fifteen days but not more than ninety days, if the offence is punishable with death, imprisonment for life or imprisonment for a term of not less than 10 years and sixty days, where the investigation relates to any other offence.
Detailed explanation-3: -Section 403 of the Police Powers Responsibility Act (Qld) states that police cannot detain a person for more than 8 hours for this purpose unless they get permission from a magistrate or justice of the peace.
