EXPLANATIONS BELOW
Concept note-1: -It provides that the president can send the U.S. Armed Forces into action abroad only by declaration of war by Congress, “statutory authorization", or in case of “a national emergency created by attack upon the United States, its territories or possessions, or its armed forces".
Concept note-2: -The Constitution grants Congress the sole power to declare war. Congress has declared war on 11 occasions, including its first declaration of war with Great Britain in 1812.
Concept note-3: -3 Declarations of War. Article I, Section 8, Clause 11: [The Congress shall have Power . . . ] To declare War, grant Letters of Marque and Reprisal, and make Rules concerning Captures on Land and Water; . . .
Concept note-4: -The Constitution divides war powers between Congress and the president. Only Congress can declare war and appropriate military funding, yet the president is commander in chief of the armed forces.
